Introduction
Conscape Canada ("we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, request a quote, contact us, or subscribe to our email newsletter.
We handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, for commercial email, Canada's Anti-Spam Legislation (CASL).
Information We Collect
We may collect the following types of information:
- Personal Information: Name, email address, phone number, city, and mailing address when you submit a contact form, a quote request, or a newsletter subscription.
- Project Details: Photos, descriptions, and preferences you provide when requesting a quote.
- Newsletter Subscription Information: Your email address and a record of your consent. The consent record includes the exact wording of the consent statement shown to you, the date and time you subscribed, the page you subscribed from, and the IP address and browser used to submit the form. We keep this record so that we can demonstrate, if asked, that you asked to hear from us.
- Usage Data: Information about how you interact with our website, including pages visited, time spent, and referring URLs.
- Device Information: Browser type, operating system, and IP address collected automatically through cookies and similar technologies.
How We Use Your Information
We use the information we collect to:
- Respond to your inquiries and quote requests
- Provide and improve our landscaping and construction services
- Communicate with you about your project
- Send our email newsletter and other marketing emails, but only where we have your consent or are otherwise permitted to do so by law. See Email Marketing and Your Consent below.
- Analyze website usage to improve user experience
- Keep records that we are required or permitted by law to keep, including records of consent
- Comply with legal obligations
Email Marketing and Your Consent
How we obtain your consent. We send our email newsletter only to people who have given us express consent to receive it. You give us that consent by entering your email address in one of the newsletter signup forms on this website and clicking Subscribe. Before you subscribe we tell you who is asking, what we will send you, and that you can withdraw your consent at any time.
What we record. When you subscribe we record the exact wording of the consent statement shown to you, the date and time, the page you subscribed from, and the IP address and browser used. We keep this record for as long as you are subscribed and for three years afterward, so that we can show your subscription was genuine.
We do not use a confirmation email step. Your subscription takes effect as soon as you submit the form. Because of that, we send you a welcome email right away which names the date and the page you subscribed from and contains a one-click link to remove yourself immediately. If you receive that email and you did not subscribe, please use that link, or contact us, and we will remove your address and add it to our do-not-contact list.
Withdrawing your consent. You can withdraw your consent at any time. Every marketing email we send contains a working unsubscribe link. You can also email or call us and ask to be removed. We will act on your request without delay, and in every case no later than 10 business days after you send it, as required by Canada's Anti-Spam Legislation. In practice unsubscribe links take effect immediately.
If you have asked us for a quote. Canada's Anti-Spam Legislation would allow us to send you commercial email for a limited period based on that relationship, even without your express consent. We do not do this. We will not add you to our newsletter because you asked us for a quote. If we want to send you our newsletter, we will ask you first.
After you unsubscribe. We keep your email address on a suppression list so that we do not contact you again by mistake, and so we have a record that we honoured your request. We do not use that list for any other purpose.
How We Protect Your Information
We implement reasonable security measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
Sharing Your Information
We do not sell, trade, or rent your personal information.
We use a small number of third-party service providers to operate our website and our business. They process personal information on our behalf, under contract, and only for the purposes we direct:
- HighLevel Inc. (GoHighLevel): our customer management and email marketing platform. It stores contact details, quote request details, and newsletter subscription and consent records. Servers are in the United States.
- Resend: delivers the notification emails our website sends when you submit a quote or contact form. Servers are in the United States.
- Vercel Inc.: our website hosting and content delivery provider. Servers are in the United States.
We may also disclose your information where we are required or permitted to do so by law, in response to a valid legal request, or where necessary to establish, exercise, or defend legal claims.
Information stored outside Canada. Several of the providers above store and process personal information in the United States. While your information is in another country it is subject to the laws of that country, and courts and authorities there may be able to obtain access to it under those laws. We use providers that commit contractually to a comparable level of protection, but we cannot exempt your information from foreign legal process. If you would prefer your information not be stored outside Canada, please contact us and we will discuss the options with you.
How Long We Keep Your Information
We keep personal information only as long as we need it for the purposes described in this policy, or as long as the law requires:
- Quote requests and contact messages that did not lead to a project: 24 months from your last contact with us.
- Project photos and descriptions submitted with a quote that did not proceed: 12 months.
- Records relating to a project we carried out, including contracts and invoices: 7 years after completion, to meet tax, accounting, warranty, and legal requirements.
- Newsletter subscription records: for as long as you are subscribed.
- Consent records: 3 years after you unsubscribe, or 3 years after the last marketing email we sent you, whichever is later. Canada's Anti-Spam Legislation places the burden of proving consent on us, and this is the period in which we may be asked to do so.
- Suppression list entries for people who have unsubscribed: kept indefinitely so that we do not contact you again by mistake. This list holds only the email address and the date and source of the request.
When a retention period ends we delete or anonymize the information. Some information may remain in encrypted backups for a limited period after deletion.
Cookies
Our website may use cookies and similar tracking technologies to enhance your browsing experience. You can choose to disable cookies through your browser settings, though this may affect some website functionality.
Third-Party Links
Our website may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policies of any third-party sites you visit.
Your Rights
You have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your personal information
- Withdraw consent for marketing communications at any time, at no cost
- Complain to us, and if you are not satisfied with our response, complain to the Office of the Privacy Commissioner of Canada
To exercise any of these rights, please contact us at admin@conscapecanada.ca. We will respond within 30 days. If we need more time we will tell you why and how much longer we need.
To unsubscribe from our newsletter you do not need to contact us. Use the unsubscribe link at the bottom of any marketing email we have sent you. If that link does not work, email us and we will remove you. We act on unsubscribe requests without delay, and in every case within 10 business days as required by Canada's Anti-Spam Legislation.
Changes to This Policy
We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated revision date. We encourage you to review this policy periodically.
